From Today (11th of January 2008) the Roma II treaty comes into effect. The Rome law was set out to give clarity to personal injury claims in the European Union. i.e. who can claim where and in what country etc. Legal Request takes a brief look at this European law change and how it affects the legal process.
Roma II will have particular effect on traffic accidents and personal injury claims that occur in Scotland. For the first time since Roma II came into force - legal proceedings can commence in English courts. This may suit you if you wish to make an accident claim and you are in Scotland.
Legal Request and our legal team can now issue proceedings in England for accidents that happen in Scotland.
In general Roma II is about cross border torts and delicts. Basically making the power of law flow freely across borders. Roma II is a harmonised set of rules within the European Union.
Historically we could only use legal representation in a Scottish court for accidents that occurred in Scotland - this also limited the amount of compensation we could get for claimants. This will have a positive effect on the amount of compensation that can be achieved from cases that happen in Scotland as legal teams are in a better position to control the level of costs in an English court. So you can expect to see some record payouts in terms of personal injury compensation in Scotland.
If you are in Scotland or have been involved in an accident that has resulted in you wishing to make a claim and you have felt that the law is not on your side, call the Legal Request for personal injury claims advice on 0800 990 3500.
