What is No Win No Fee?

No Win No Fee agreements, also known as Conditional Fee Agreements, were introduced in the UK in 1995 to improve access to justice. It is designed to help people who can’t afford exorbitant legal fees use the legal system to fight for what they deserve.
What happens if I lose a claim when using No Win No Fee?
The general rule in the courts is that the losing side pays the winning side’s legal costs. If you are under a No Win No Fee agreement your solicitor will see if you have legal insurance to pay the costs. If you do not have insurance before you approach the solicitor, you will be able to take out after-the-event (ATE) insurance, which will cover you in the event you do happen to lose your claim.
What happens if I win under a No Win No Fee claim Agreement?
Quite simply, you get to keep everything! The court will award you damages, which you will keep in its entirety. Your solicitor will then claim its own legal costs from the other side. You therefore keep all your damages for yourself, and the solicitor will not take a penny of it.
It is a common misconception that personal injury lawyers take a percentage of damages. This may happen in the USA, but it does not happen in the UK. No Win No Fee is a just and fair way to help people achieve justice.
Can I use a No Win No Fee agreement for any claim?
You will have to check with your solicitor if they will take on a No Win No Fee agreement. Generally it is only personal injury claims which attract this type of agreement and even then, there are certain medical negligence claims which may attract fees. However, you will need to get advice from your solicitor.
